Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Hey Birds, operated at heybirdz.com and related apps (the “Service”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.

1. Eligibility & Accounts

You must be at least 13 years old to create an account. You’re responsible for keeping your account credentials secure and for all activity under your account. Let us know right away if you suspect unauthorized use.

2. The Service

Hey Birds pulls local events from a variety of sources (local venues and calendars, more established event platforms, and community submissions) and provides a personalized concierge, saved events/itineraries, and gamified badges. We do our best to keep listings accurate and current, but event details (time, location, price, cancellation) can change on the source’s end — always confirm details with the organizer or venue before attending, especially for anything you’re paying or traveling for.

3. Plans & Billing

Hey Birds offers a free plan and paid subscription plans (currently Pro and Family).

  • Paid plans renew automatically (monthly or yearly, per your selection) until you cancel. Payment is processed securely by Stripe.
  • You can cancel anytime from your account’s billing/manage-subscription page (powered by Stripe’s Customer Portal); your plan stays active through the end of the current billing period, then reverts to Free.
  • Prices may change with advance notice. Continuing to use a paid plan after a price change takes effect means you accept the new price.
  • Fees are generally non-refundable except where required by law; contact us at hello@heybirdz.comif something went wrong with a charge and we’ll take a look.

4. Community Content & Conduct

You can submit events and (for businesses) ads for our team to review. By submitting content, you confirm it’s accurate and that you have the right to share it, and you grant Hey Birds a license to display it on the Service. We may edit, decline, pause, or remove any submission — including previously approved content — at our discretion, for example if it violates our content guidelines, is inaccurate, or is reported as problematic.

You agree not to use the Service to:

  • Submit false, misleading, illegal, or infringing content.
  • Harass, abuse, or harm any person or group.
  • Scrape, resell, or misuse Service data beyond normal personal use.
  • Attempt to bypass rate limits, tier restrictions, or security controls.

5. AI Concierge

The concierge chat uses AI to suggest events and answer local-planning questions based on your preferences and public event data. It’s meant for planning convenience — it can be wrong, out of date, or miss context, so treat its suggestions as a starting point, not a guarantee. Don’t rely on it for anything safety-critical.

6. Badges & Gamification

Badges are a fun way to recognize engagement and are awarded based on self-reported activity (like “I went!” check-ins) or, where available, optional proximity check-ins. They carry no cash value and may be adjusted, renamed, or retired as the Service evolves.

7. Intellectual Property

The Hey Birds name, logo, and Service design are owned by us. Individual event listings may be owned by their original source/organizer. You may use the Service for personal, non-commercial event discovery — not to build a competing product from our data.

8. Third-Party Links & Content

The Service links to and displays information from third parties (event organizers, ticketing platforms, venues). We aren’t responsible for the accuracy, safety, or content of third-party sites, and linking to them isn’t an endorsement.

9. Disclaimers

The Service is provided “as is” without warranties of any kind, express or implied. We don’t guarantee the Service will be uninterrupted, error-free, or that event information will always be accurate or current.

10. Limitation of Liability

To the fullest extent permitted by law, Hey Birds and its team aren’t liable for indirect, incidental, special, or consequential damages arising from your use of the Service, including anything related to an event you attended based on information found here. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose (or $50 if you’re on the free plan).

11. Termination

You can stop using the Service and delete your account anytime. We may suspend or terminate accounts that violate these Terms, with or without notice, depending on severity.

12. Governing Law

These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law rules.

13. Changes to These Terms

We may update these Terms as the Service evolves. We’ll update the “Last updated” date above, and for material changes we’ll take reasonable steps to notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.
